Travis Barker files suit over plane crash
Travis Barker , who survived a serious plane crash in September, reportedly has filed a lawsuit that alleges the plane was defective and the pilots were negligent.
The suit, filed in Los Angeles Superior Court, claims that the plane's landing gear, tires, wheels, brakes, reverse thrust system, squat switches and component parts were not airworthy, according to a TV Guide report.
The former Blink-182 drummer also claims the pilots were largely responsible for the accident in which two people were severely injured and four others died. The suit reportedly claims the pilots' decision was a breach of their duty owed to the passengers and was a substantial factor in causing the crash and resultant injuries and deaths.
Barker---who filed the suit with Thelma Martin Still, the mother of Charles Still, who died in the Sept. 19 plane crash--reportedly is seeking more than $25,000 in damages for pain and suffering, disfigurement, loss of earnings, and medical and legal expenses. Still has cited damages including grief and sorrow, funeral expenses and loss of earnings.
Several parties were named in the legal action including Goodyear Tire and Rubber; Toronto-based Bombardier Inc., which the suit claims was responsible for maintaining the aircraft; Global Exec Aviation, the Long Beach, CA-based charter company that owned the jet; and two charter firms that brokered the flight, Clay Lacy Aviation Inc. and Inter Travel and Services Inc., according to a foxnews.com report.
A spokesperson for Clay Lacy Aviation said neither the company, its aircraft nor its crews were involved in the accident, according to an E! News report. No statements have been issued any of the other parties.
