Briefly: My Chemical Romance, Hawthorne Heights, Aimee Mann, Motley Crue

My Chemical Romance didn't perform as scheduled at the San Diego Street Scene festival on Saturday (8/5) because members of the band apparently were injured two days earlier in a car crash.

Though specifics about the injuries and the accident haven't surfaced, a press release issued by the band's label said that the band members "did all they could, including traveling to San Diego and attempting to rehearse against doctor's orders. However, when the injuries proved to painful to play, they decided not to push it any further. The band will return to San Diego in the near future, and they send their sincerest apologies to the fans that came out to see them."

Rockers Hawthorne Heights say they've left Victory Records, and have also filed a lawsuit against the label and its owner.

The complaint, filed today in a US District Court in Illinois, alleges that label owner Tony Brummel issued a "manifesto calling rock supporters to arms and a virtual declaration of war on hip-hop and Ne-Yo done under the guise of a band message, as well as the street team letter which instructed people to re-arrange our CDs, putting them in higher visibility areas in stores," according to a statement posted on Hawthorne Heights' website.

Hawthorne Heights' latest album was issued on Feb. 28, the same day as Ne-Yo's new disc. Ne-Yo debuted at No. 1 on The Billboard 200 album chart, while Hawthorne Heights entered the chart at No. 3.

"At the time of the letters we were branded as racists by some, all over a letter we did NOT write, targeting a genre which we have NOTHING against whatsoever. Because of these letters, our second album debuted at No. 3 on the charts, an incredible feat, which would normally be cause for joy, but now is tainted much like Barry Bonds' statistics."

Among other charges, Hawthorne Heights' complaint alleges the label has engaged in "egregiously fraudulent accounting practices," and that "[d]espite having sold nearly 1.5 million units of Hawthorne Heights' recordings and videos, Victory and Brummel claim that Hawthorne Heights owes Victory in excess of one million dollars."

Singer/songwriter Aimee Mann plans to release a Christmas album this fall. Among the classics she recorded for the set, titled "One More Drifter in the Snow," are "Winter Wonderland," "Have Yourself a Merry Little Christmas" and "God Rest Ye Merry Gentlemen." The set will also include the Mann original "Calling on Mary."
