Great White offers to settle lawsuits over club fire
Great White has offered $1 million to settle lawsuits over a 2003 nightclub fire in which 100 people died and more than 200 were injured. More than 300 parties and the presiding federal judge must approve the settlement. which stipulates that the band does not admit to any wrongdoing for the fire. The blaze started when pyrotechnics ignited packaging foam that the club owners had used as soundproofing, according to an Associated Press report.
Several dozen defendants have been sued by victims and survivors including foam companies, the radio station that ran ads for the show, the club owners and the local fire marshal who failed to cite the club for the foam on the walls and ceilings.
In addition to the band's offer, about $175 million has been offered by dozens of defendants to settle the suit. Last month, the state and township offered to settle claims for $10 million each. No settlement money has been distributed, however. A Duke University law professor reportedly has been appointed to work out a formula to determine how much money each person should receive in the piece-meal settlement.
The band's manager, Daniel Biechele, who lit the pyrotechnics that ignited the packaging foam, pleaded guilty in 2006 to 100 counts of involuntary manslaughter. Biechele, who was sentenced to four years in prison, was paroled in March after serving less than half his time.
Besides Biechele, the only people charged were the owners of The Station nightclub in West Warwick, RI; both pleaded no contest to 100 counts of involuntary manslaughter. One, Michael Derderian, will be out on parole next year. The other, Jeffrey Derderian, received no jail time but was given community service and probation.
